03-07-2024Atishi, Delhi's Planning Minister, has declared an order from Lieutenant Governor (LG) VK Saxena and the Services Department rescinding non-official members of the Dialogue and Development Commission of Delhi (DDCD) as "null and void". Atishi emphasized that the LG lacks jurisdiction over matters under the elected Delhi government, asserting that the DDCD was constituted by the elected government and falls under its exclusive executive powers.
The controversy arose when Saxena approved the dissolution of DDCD and removal of its non-official members pending the establishment of a new mechanism for selecting domain experts. Atishi's directive, marking the order to relevant officials, reinstated the non-official members and criticized Saxena's decision for lacking proper communication and exceeding his authority.
According to Atishi, the appointment and removal of non-official members are solely within the Chief Minister's jurisdiction, and any actions contrary to this authority are deemed illegal. She accused the Services Department and LG of a "colourable exercise of power" and misuse of authority, vowing disciplinary actions against officials involved in implementing the orders without her approval.
Atishi highlighted that the non-official members were selected based on their expertise, challenging the legitimacy of the Services Department's interference in what she described as matters falling under the political executive rather than the permanent executive.
The reinstatement underscores ongoing power struggles between Delhi's elected government and the LG, reflecting broader issues of jurisdiction and autonomy in the National Capital Territory's governance structure.
