Shah Rukh Khan Wins Tax Dispute Against Income Tax Department

09-03-2025Actor Shah Rukh Khan has won a significant legal battle against the Income Tax authorities, with the Income Tax Appellate Tribunal (ITAT) ruling in his favor.
The case revolved around the taxation of his 2011 film, RA One.
The Income Tax Department had disputed Khan’s reported earnings of ₹83.42 crore for the financial year 2011-2012, rejecting his request for foreign tax credit on taxes paid in the UK. Over four years later, the department reassessed his tax liability, raising it to ₹84.17 crore.
However, the ITAT determined that the reassessment was not legally justified. According to the tribunal, the tax officials did not present "any fresh tangible material" that would warrant reopening the case beyond the statutory four-year limit.
Since the issue had already been reviewed during the initial assessment, ITAT concluded that the reassessment was invalid on multiple legal grounds.
Under Khan’s agreement with Red Chillies Entertainment, 70% of the film’s shooting was conducted in the UK, making the same proportion of his income taxable there. The Income Tax Department argued that this arrangement resulted in a revenue loss for India and, as a result, denied his foreign tax credit claim.
The ITAT’s decision marks a major relief for the Bollywood star in his long-standing tax dispute.
