UAE Approves Abortions in Rape and Incest Cases

The UAE Cabinet approves a resolution allowing abortions in cases of rape and incest, contrasting with restrictive US state laws amid ongoing global debates on reproductive rights

The United Arab Emirates (UAE) is poised to introduce significant reforms allowing abortions in cases of rape and incest, potentially resulting in more lenient abortion laws compared to several US states. This development follows the US Supreme Court's 2022 decision to eliminate federal constitutional protections for abortion, leading 14 US states to enact stringent bans on the procedure.

In stark contrast, the UAE Cabinet has recently approved a resolution that permits abortions under specific circumstances. According to Cabinet Resolution No. (44) of 2024, abortions will be allowed if the pregnancy results from non-consensual intercourse or incest, provided the incident is reported promptly and the procedure is conducted within 120 days of pregnancy.

The resolution marks a notable departure from previous UAE policies, signaling a progressive shift in the country's approach to reproductive rights. Once officially published in the UAE's Official Gazette, the resolution will come into effect, making these allowances legally binding.

The decision places the UAE ahead of several US states where abortion access is severely restricted. For instance, nine US states—including Alabama, Arkansas, Kentucky, Louisiana, Missouri, Oklahoma, South Dakota, Tennessee, and Texas—prohibit abortions even in cases of rape or incest. Other states like Arizona ban abortions after 15 weeks without exceptions for these circumstances, while Mississippi and Idaho require victims to report to law enforcement for exemptions under their abortion bans.

Dr. Paul Bosio, Chief Medical Officer at Corniche Hospital in Abu Dhabi, hailed the resolution as a significant step towards safeguarding women's health and autonomy. He emphasized that the new policy aims to protect women's well-being and ensure their rights to make informed decisions about their bodies.

The reform underscores the UAE's commitment to advancing women's rights and healthcare standards. Its adoption of more inclusive abortion laws reflects broader global trends towards greater reproductive rights and access to healthcare services.

This legislative change in the UAE is expected to have profound implications for women's health and legal rights in the region, positioning the country as a potential leader in reproductive healthcare reform compared to its international counterparts.
