CBI to Produce Arvind Kejriwal in Court Amid Supreme Court Bail Hearing

26-06-2024In a significant development for the jailed Delhi Chief Minister Arvind Kejriwal, the Central Bureau of Investigation (CBI) is set to produce him before a trial court on Wednesday, potentially leading to his arrest by the central agency. This comes as the Supreme Court is scheduled to hear Kejriwal's plea challenging a Delhi High Court order that had paused his bail granted by a lower court.
Earlier this week, the CBI questioned Kejriwal in Tihar Jail concerning the liquor policy case, recording his statement. Following this, the CBI submitted an application to a special court seeking a production warrant for Kejriwal, which was subsequently issued.
Kejriwal is expected to be brought before the trial court at 10 am on Wednesday, likely ahead of the Supreme Court hearing. Given that he is currently in judicial custody for a case involving the Enforcement Directorate (ED), his formal arrest by the CBI could occur in the court. If the CBI secures custody of Kejriwal, he will remain in Tihar Jail on Wednesday even if the Supreme Court overturns the High Court's stay on his bail.
The Aam Aadmi Party (AAP) has strongly criticized this move, accusing the CBI of fabricating charges against Kejriwal. AAP Rajya Sabha MP Sanjay Singh claimed that there is a deliberate conspiracy to arrest the Delhi Chief Minister on false charges by the central agency, just as the Supreme Court might grant him bail.
On June 20, a Delhi court granted bail to Kejriwal, who was arrested on March 21 by the ED, ordering his release on a personal bond of Rs 1 lakh. However, the ED contested this decision in the Delhi High Court, which then stayed the bail order on June 21 and reserved its judgment for June 25. Kejriwal's legal team approached the Supreme Court, seeking to overturn the stay, but the Supreme Court advised waiting for the High Court's decision.
On June 25, the Delhi High Court issued its order, stating that the trial court had not specified the conditions for Kejriwal's release under the Prevention of Money Laundering Act (PMLA), under which he was charged.
