CJI Surya Kant Warns of Contempt After Attempt to Question His Order

Top court rebukes interference bid, flags misuse of minority quota in medical admissions case

In a strongly worded hearing, Chief Justice of India Surya Kant criticised an alleged attempt to challenge his judicial order through informal channels, cautioning that such actions could invite criminal contempt proceedings.

While hearing a case related to medical admissions, the Chief Justice disclosed that an individual had contacted his brother to question the basis of a court ruling. Expressing serious concern, he questioned how anyone could attempt to indirectly influence or scrutinise a judicial decision in such a manner, and asked counsel to verify the matter immediately.

He issued a clear warning that such conduct would not be tolerated, adding that even attempts to evade accountability would not shield those involved. The remarks underscored the judiciary’s firm stance against any perceived interference with its functioning.

Minority quota case under scrutiny

The observations came during proceedings linked to admissions under a minority quota at a medical institution in Meerut. The petitioners, siblings seeking postgraduate seats, claimed eligibility under the Buddhist minority category after converting religions, despite earlier applying as general category candidates.

Their admissions were put on hold following a state government directive, prompting them to approach the court.

Taking a critical view, the bench raised concerns over possible misuse of reservation provisions. It questioned the timing of the religious conversion and whether such changes were being used strategically to gain admission advantages.

The court also examined how minority certificates were issued in the first place, seeking clarity on the process followed by local authorities. Directions were issued to the Haryana government to present the guidelines governing such certifications.

The bench further remarked on the broader implications of such cases, stressing that reservation benefits are meant to protect genuinely disadvantaged groups and should not be exploited.
