Delhi High Court to Hear CM Arvind Kejriwal's Plea Against CBI Arrest Warrant

The Delhi High Court is set to hear Chief Minister Arvind Kejriwal's plea challenging the CBI's recent arrest warrant, with the hearing scheduled for Tuesday

On Tuesday, the Delhi High Court will hear a plea filed by Chief Minister Arvind Kejriwal challenging the Central Bureau of Investigation's (CBI) recent arrest warrant. The hearing will be conducted by a bench led by Justice Neena Bansal Krishna.

In his plea, Kejriwal raised several key points contesting his arrest by the CBI. He asserted that he was initially summoned by the CBI over a year ago merely as a witness and emphasized that no new evidence or justification for his arrest has been presented in the CBI's arrest memo or grounds of arrest. Kejriwal noted that during his judicial custody, the CBI failed to provide any new material supporting his detention, with all allegations mentioned already part of previous CBI chargesheets.

Kejriwal's plea highlighted that the claims made by the CBI in their remand application were part of earlier chargesheets filed by the agency. He also pointed out the lack of justification in the arrest memo for his detention after two years of investigation.

Kejriwal referenced statements made by the Solicitor General (SG) before the Supreme Court in June, where an assurance was given regarding the timely filing of the final chargesheet by July 3. During the bail proceedings of his co-accused Manish Sisodia on June 4, the SG explicitly stated that the investigation was nearing its conclusion and no fresh arrests were anticipated.

The plea argued that the SG’s statement did not mention any intention of making fresh arrests. Kejriwal contended that the assurances made by the SG indicated that no further arrests were planned, as the investigation was near its conclusion.

Further, Kejriwal’s plea mentioned that despite obtaining the necessary sanction on April 23, the CBI chose not to arrest him immediately and subsequently made statements before the Supreme Court suggesting that no further arrests would be made.

The High Court is set to hear Kejriwal’s plea tomorrow.

The CBI arrested Delhi Chief Minister Arvind Kejriwal on June 26 in connection with the liquor policy case. This arrest follows the Enforcement Directorate's earlier arrest of Kejriwal on March 21 in a related money laundering case.
