US Court Unseals Arrest Warrant Against Gautam Adani Over Bribery Charges

A New York court has unsealed an arrest warrant against Gautam Adani, alleging bribery and fraud linked to solar energy contracts in India

A New York court recently unsealed an arrest warrant against billionaire industrialist Gautam Adani, following his indictment on charges of bribery and fraud. The unsealing, ordered by Judge Robert M. Levy on October 31, 2024, allows the warrant to be shared with foreign law enforcement agencies.

The move came after an application by the US Attorney for the Eastern District of New York. Under American law, courts issue arrest warrants when there is little confidence that the accused will voluntarily appear before the court.

Allegations of Bribery and Fraud

US prosecutors allege that Adani, his nephew, and six other individuals paid $265 million (approximately ₹2,029 crore) in bribes to Indian government officials between 2020 and 2024. The bribes were reportedly aimed at securing solar power contracts with state electricity distribution companies.

The indictment further claims that this information was deliberately hidden from US banks and investors, from whom the Adani Group raised billions of dollars to fund the solar energy project. The project, spanning over two decades, was anticipated to generate profits exceeding $2 billion.

The Link Between Indian and US Jurisdictions

Although the alleged bribery involved Indian state officials, US laws enable the prosecution of corruption cases if they impact American investors or markets. The Adani Group has rejected the charges, labeling them "baseless" and vowing to address the allegations through legal means.

Solar Energy Contracts Under Scrutiny

The allegations revolve around a contract secured by Adani Green Energy and another renewable energy firm, Azure Power, to supply 12 gigawatts of solar electricity to the Solar Energy Corporation of India (SECI). However, SECI faced challenges in finding buyers for the solar power due to its high cost.

To salvage the deal, Adani and Azure Power allegedly conspired to pay bribes to officials in several Indian states, including Andhra Pradesh, Chhattisgarh, Tamil Nadu, Odisha, and Jammu and Kashmir. These bribes purportedly facilitated agreements with state-run power distribution companies, ensuring the continuation of the project.

As the case unfolds, the allegations and their implications for both the Adani Group and international investors are likely to remain under intense scrutiny.
