Uttarakhand Becomes First Indian State to Implement Uniform Civil Code

Uttarakhand creates history by officially rolling out the Uniform Civil Code, ensuring equality in personal laws across the state

Uttarakhand is making history today as it officially becomes the first Indian state to implement the Uniform Civil Code (UCC). The groundbreaking legislation is set to be launched at approximately 12:30 PM, coinciding with Prime Minister Narendra Modi’s visit to the state.

Chief Minister Pushkar Singh Dhami will oversee the launch of the UCC portal at the state secretariat. Speaking about this milestone, Dhami emphasized that the UCC aims to foster a harmonious and inclusive society, free from discrimination based on religion, gender, caste, or community. He described the move as fulfilling a promise made to the people of Uttarakhand, drawing parallels to other significant reforms under PM Modi's leadership, such as the abrogation of Article 370 in Jammu and Kashmir.

“The UCC will lay the foundation for an equitable and discrimination-free society,” Dhami said, reiterating the state government’s commitment to upholding the vision of a secular and unified India.

Key Features of Uttarakhand’s UCC

  1. Equal Property Rights for Sons and Daughters
    Both sons and daughters will have equal property rights, irrespective of their category or religion.

  2. Marriage Provisions
    The UCC establishes monogamy as the legal standard and prohibits polygamy. Marriage registration will be mandatory, though ceremonies may follow religious customs. Legal marriage ages are set at 21 for men and 18 for women.

  3. Abolishing Discrimination Among Children
    The code eliminates distinctions between legitimate and illegitimate children in matters of inheritance. All children, including adopted, biological, or born through assisted reproductive technologies, will have equal rights.

  4. Equal Rights After Death
    Following a person’s death, the UCC ensures equal inheritance rights for the spouse, children, and parents.

The Uniform Civil Code Bill 2024

The UCC Bill, passed by the Uttarakhand Assembly in February 2024, was a significant step toward unifying personal laws governing marriage, divorce, inheritance, and live-in relationships. Despite opposition demands to refer it to a select committee, the bill was approved, receiving presidential assent in March 2024.

CM Dhami highlighted that the UCC would particularly benefit women by addressing systemic discrimination in areas like inheritance, maintenance, and divorce. “This legislation brings equality for everyone, creating a society where no one is left behind due to outdated practices,” he remarked.

The implementation of the UCC across Uttarakhand, including for residents living outside the state, is a landmark achievement, setting a precedent for the rest of the country.
