Supreme Court Puts UGC’s New Campus Equity Rules on Hold
India’s top court has paused the UGC’s latest anti-discrimination framework for universities, citing concerns over clarity and possible misuse
29-01-2026The Supreme Court of India has temporarily suspended the University Grants Commission’s newly introduced 2026 regulations aimed at promoting fairness and preventing discrimination in higher education institutions.
The rules were designed to address bias related to caste, religion, gender, and other identities by requiring universities to form dedicated oversight committees and enforce penalties for violations. However, a bench headed by Chief Justice Surya Kant expressed preliminary concerns, stating that the guidelines appear unclear and could potentially be misapplied.
As a result, the court has restored the earlier 2012 regulatory framework until the matter is heard again on March 19.
The decision has drawn mixed reactions. Some commentators have welcomed the stay, arguing that the new rules might lead to unintended or reverse discrimination. On the other hand, supporters of the regulations, including Tamil Nadu Chief Minister M.K. Stalin, have emphasized the importance of maintaining strong protective measures to prevent harassment and ensure safety for students from marginalized communities on campuses.
